What is a Family-Based Petition?
Family members, close and distant, can immigrate to the United States with the help of a permanent resident, such as a parent, child, or spouse, and a family-based petition. It allows U.S. citizens or lawful permanent residents (LPRs) to sponsor immediate relatives and family members, from children to spouses and siblings.
There are two family-based categories: immediate relatives and family preference.
Immediate relatives include a spouse and minor children under 21 years of age. Family preference involves more distant family members, and there are four preference categories:
FAMILY-SPONSORED PREFERENCES
- First: (F1) Unmarried Sons and Daughters of U.S. Citizens: 23,400 plus any numbers not required for fourth preference.
- Second: Spouses and Children, and Unmarried Sons and Daughters of Permanent Residents: 114,200, plus the number (if any) by which the worldwide family preference level exceeds 226,000, plus any unused first preference numbers:
- A. (F2A) Spouses and Children of Permanent Residents: 77% of the overall second preference limitation, of which 75% are exempt from the per-country limit;
- B. (F2B) Unmarried Sons and Daughters (21 years of age or older) of Permanent Residents: 23% of the overall second preference limitation.
- Third: (F3) Married Sons and Daughters of U.S. Citizens: 23,400, plus any numbers not required by first and second preferences.
- Fourth: (F4) Brothers and Sisters of Adult U.S. Citizens: 65,000, plus any numbers not required by first three preferences.
How Does Family-Based Immigration Work?
Staying together is important for many families, and family immigration is often how many people come to the United States. Under current immigration law, family immigration allows U.S. citizens and lawful permanent residents to sponsor certain family members for immigrant visas or “green cards.”
This gives people permanent residence while they pursue permanent U.S. citizenship. Family visas account for nearly 65 percent of legal immigration annually, per the National Immigration Forum.
An immigrant typically sponsors more than three relatives, including spouses and children.
